End User License Agreement
Mineshire is made by LogicByte Studios (“we”, “us”). This End User License Agreement (the “Agreement”) is the contract that lets you use the Mineshire desktop application for Windows and every update we release for it (together, the “Software”).
Please read it before you install Mineshire. By installing, copying or using the Software you agree to it. If you don’t agree, don’t install or use the Software.
1. Definitions
In this Agreement:
- “Server software” means the programs Mineshire downloads and runs for you, such as Mojang’s Minecraft server and community servers like Paper, Purpur, Fabric and NeoForge.
- “Add-ons” means plugins, mods, data packs and modpacks that you install into a server, through Mineshire or by hand.
- “Third-party services” means websites and services run by others that Mineshire connects to, for example Modrinth, CurseForge, Mojang, GitHub, Discord, Google Drive, playit.gg, minelog.org and motd.gg.
- “Your servers” means the Minecraft servers you create, import or run with the Software.
2. Who can accept this Agreement
Mineshire is for people aged 13 and over. Younger than 18? Then a parent or guardian has to read this Agreement and accept it for you, and they answer for how you use the Software.
Accepting for a club or a company? Then you’re confirming that you’re allowed to commit it, and “you” means the organisation.
3. Licence
You may install the Software on any computer you own or control and use it to create, manage and run Minecraft servers for yourself and the people you play with. The licence is personal to you, it isn’t exclusive, you can’t pass it to anyone else, and we can withdraw it as described under Termination. Keeping a spare copy of the installer as a backup is fine.
You are getting a licence, not buying the Software. Whatever this Agreement doesn’t hand to you stays with us.
4. Restrictions
Don’t do any of the following, and don’t help anyone else do them:
- copy, sell, rent, lease or hand out the Software, or build it into a product or service of your own;
- take the Software apart to get at its source code (reverse engineering, decompiling or disassembling it), unless the law gives you that right regardless;
- modify the Software, create works based on it, or remove or change a notice of ownership;
- bypass or switch off the signature check that protects updates, or install an update that we did not publish;
- use the Software to attack, overload or gain unauthorised access to any system, including other people’s servers;
- use the Software to infringe someone’s rights or to break the law;
- reach our online services by automated means other than through the Software, or in a way that could damage or overload them.
5. Minecraft and third-party software
Mineshire is an independent product. Mojang AB, Microsoft and the server software projects did not make it and have not approved it. “Minecraft” is Mojang’s trademark, and the other names mentioned here belong to whoever owns them.
When you ask for server software or an add-on, Mineshire downloads it from the source named in the app and puts it on your computer. Every program and add-on is its author’s property and comes with the author’s own licence. We haven’t reviewed or tested them and we don’t vouch for them; if one misbehaves, that isn’t on us. A few authors only allow downloads from their own page, and for those Mineshire opens that page instead of fetching the file.
Before Mineshire creates a server it asks you to accept the Minecraft EULA by ticking a box. Once you have ticked it, Mineshire records the acceptance in the server’s eula.txt file on your behalf. The acceptance is yours, so read the Minecraft EULA and Mojang’s usage guidelines first and accept only if you agree with them.
6. Your servers and your responsibility
Your servers run on your computer and under your control. We do not host, monitor or moderate them. You are responsible for:
- how you set up your servers, including the memory they use, the files you add and the people you let in;
- the conduct of your players and the rules of your server;
- the security of your computer, your router and your network, including every port you open;
- making and keeping backups of your worlds and files;
- following the law and the rules of Minecraft that apply to your server, including Mojang’s commercial usage guidelines if you charge for access or run a business around it.
If you use the tunnel feature, a program made by playit.gg is downloaded once you agree, and it then relays traffic between your players and your computer. playit.gg is a separate service with its own terms and privacy policy. A server that is open to the internet can be reached by everyone who has its address.
7. Updates
The Software can look for newer versions and, when you choose, download and install them. Looking is switched on by default and can be switched off in Settings, under Updates. We sign every update, and the Software checks that signature before it installs anything.
An update can add, change or remove features. It replaces the version you have, and this Agreement as it then stands applies to it.
8. Alpha status and your data
Mineshire is in alpha. We release it early so that people can use it and tell us what breaks. Features may change, stop working or disappear, and a bug may damage a server, a world or other files. Back up anything you care about before you rely on the Software, and try changes on a copy first.
9. Accounts, online features and third-party services
Some parts of Mineshire connect to online services: signing in, the list of your servers on your account, sharing a server with a friend, remote control from the website, announcements and update checks. Our Terms of Use and Privacy Policy cover these.
Third-party services have their own terms. When you use them through Mineshire you deal with them directly. We are not a party to that relationship and we are not responsible for those services.
10. Ownership and feedback
The Software, including its design, code, text and artwork, belongs to us or our licensors and is protected by copyright and other laws. The names Mineshire and LogicByte Studios and our logos are ours. This Agreement gives you no right to use them except to refer to the Software accurately.
If you send us ideas or suggestions, you allow us to use them freely, without payment and without crediting you.
11. Components made by others
The Software includes components made by others under their own licences. Those licences stay in force and may give you more rights in a component than this Agreement gives you in the Software as a whole. A list of the components and their notices is available on request at legal@mineshire.com.
12. Disclaimer of warranties
As far as the law allows, the Software comes “as is” and “as available”, with no warranties of any kind, express or implied, including any warranty of fitness for a particular purpose or of non-infringement. We can’t promise that Mineshire will run without hiccups, that it will fit what you need, or that it will never harm your data.
Your consumer rights under the law where you live stay as they are, whatever this Agreement says, wherever a contract can’t take them away.
13. Limitation of liability
We stay responsible for death or personal injury caused by our negligence, for fraud and fraudulent misrepresentation, and for anything else the law doesn’t let us limit.
Beyond that, and as far as the law allows, we aren’t liable for lost data, lost worlds, lost profit, revenue, goodwill or business, or for indirect or consequential loss, if it comes from using the Software. Our total liability to you for everything connected with the Software is capped at what you paid for it, which is nothing while it’s free.
14. Termination
This Agreement lasts until it ends. You can end it at any time by uninstalling the Software and deleting your copies. We may end it, or suspend your use of our online services, if you break it, for example by doing something listed under Restrictions, or if the law requires us to.
When it ends your licence stops and you must stop using the Software. Your servers, worlds and files stay on your computer; we have no access to them and no right to remove them. The parts of this Agreement that by their nature should carry on, such as ownership, the disclaimer, the limit on liability and the governing law, do so.
15. Changes to this Agreement
This Agreement will change now and then, whenever a new feature needs new wording or the law moves. The date at the top tells you when that last happened. Each new version goes on mineshire.com, and material changes are noted in the changelog. Keep using the Software after a change takes effect and you’re accepting the new version; if you don’t agree with it, stop using the Software.
16. Governing law and courts
The law of England and Wales applies to this Agreement and to every dispute or claim that comes out of it or relates to it, including claims that aren’t about the contract itself. Only the courts of England and Wales may hear them. If you’re a consumer, you can also go to the courts of the country where you live, and that country’s mandatory consumer protections still apply to you.
17. General
Together with the Terms of Use and the Privacy Policy, this Agreement is everything we’ve agreed about the Software. If a court finds one part unenforceable, the rest still applies. Not enforcing a right the moment it arises doesn’t mean we’ve given it up.
Your rights under this Agreement can’t be transferred. Ours can, as part of a business transfer. Nobody outside this contract can enforce it. The Agreement is in English, and any translation is only there to help you read it.
